LAVENDER, Justice:
This is an appeal from the trial court’s order denying appellant’s motion to vacate an order of summary judgment. Appellant’s cause of action for double damages, to-wit: the amount of the increased purchase price of the goods, based upon respondent’s failure to pay timely the contracted sales price, was rejected as a counterclaim in a defense to respondent’s action for unlawful detainer.
The essential question presented is whether a counterclaim may be asserted as a defense in a non-payment-of-rent action. We answer that question in the affirmative.
We have previously held that a counterclaim which relates to the same transaction as the petition will be adjudicated in the same action. Robinson v. Hennessee, 187 Okl. 132, 101 P.2d 39 (1940). The same rule is applicable in a landlord-tenant action and for a like reason may be applied to the counterclaim of one who seeks to recover the purchase price of merchandise sold.
The rule, however, does not apply when the counterclaim is based on a separate and distinct transaction. In that instance, a counterclaim is not an issue in the case.
